Walking into a vape shop in one state might feel completely different from stepping into one across the border. In some places, rows of fruit and mint flavors line the shelves. In others, only plain tobacco or menthol options remain.

A Breakdown of State-Level Ban Models
Model 1: The Total Ban (Menthol Included)
Some states have taken the strongest approach by implementing a comprehensive flavored vape ban that includes nearly all flavored tobacco and vape products, even menthol.
California is the best-known example.
In 2022, voters upheld the California flavored vape ban that removed most flavored options from the market.
This means fruit, candy, mint, and menthol varieties of e-cigs, vapes, and even traditional varieties of e-cigs, vapes, and even traditional cigarettes are no longer allowed on store shelves.
There are a few narrow exceptions, such as certain premium cigars or hookah products sold in licensed lounges, but the overall effect is a near-total removal of flavors.
Other States with Similar Laws:
Massachusetts, New York, New Jersey, and Washington D.C. have also passed laws that follow this model, cutting flavored and menthol products out of their markets.
Model 2: The Ban with Menthol Exemptions

Since January 1, 2025, fruity and sweet varieties can no longer be sold, while menthol products are still allowed—though with added taxes and stricter rules.
A similar rule has taken shape in Utah.
Starting January 1, 2025, Utah rolled out a statewide flavored vape ban but menthol (and in some cases mint) is still permitted in non-specialty and specialty retailers.
Model 3: The Flavor Ban on Specific Products
In some places, only particular flavored items are targeted, rather than a blanket flavored vape ban.
Florida offers a textbook example: the state passed a law in April 2024 (effective October 1, 2024) that specifically targets single-use disposable vapes deemed “attractive to minors.”
Retailers must remove these products, or face serious consequences.
What to Check if Your State Isn’t on the List?
Not seeing your state mentioned yet? That doesn’t necessarily mean flavored vapes are free from restrictions. With the ongoing spread of the flavored vape ban movement, regulations can be layered, and sometimes they're updated quietly. Here are the main places you should check:
1. Local Laws
Even if your state hasn’t passed a flavored vape ban, cities and counties often set their own rules. For example, some large metro areas have banned flavored tobacco products even when the state hasn’t. Always look into local ordinances before assuming products are available.
2. State Websites
Every state has an official health or tobacco control department that posts current laws and enforcement details. These websites are the most reliable place to confirm whether a flavored vape ban has been put into effect where you live.
3. Federal Regulations
On top of state and local rules, federal laws still apply. The nationwide "Tobacco 21" law, which raised the minimum sales age to 21, is one example. The FDA also has the authority to review and restrict flavored products on a national level, which means rules could shift again in the future.
